There is a chance that you’ll need to resolve your divorce case in a Minnesota courtroom. However, if you communicate reasonably well with your spouse, it may be possible to do so through alternate methods. In most cases, this means working with a mediator to come to terms on issues such as dividing joint assets.

You’re working with your spouse to come to an agreement

One of the key benefits of reaching a settlement outside of court is that the process of doing so is a mutual one. Instead of trying to obtain the most favorable outcome for yourself at the expense of your spouse, your goal is to find common ground In most cases, this approach is the one that allows you to negotiate an agreement in less time and with less drama.

Your children are kept away from the drama

If you share children with your spouse, you’ll want to shield them from the details of why their parents are splitting up. Dissolving a marriage through divorce mediation can make it easier to accomplish this goal. This is because the terms of the agreement are sealed, which means that they won’t be able to learn about them online, on television or from a friend.

You can’t predict what a judge will do

There is no way to predict how a judge will rule in your case until the order is handed down. In some cases, the order may be less favorable than the one you could have worked out during mediation or arbitration. As a general rule, you can’t appeal the decree after it has been issued.

Regardless of how you choose to end your marriage, it may be best to do so with the assistance of a divorce lawyer. You will want to have your attorney at every stage of the process, especially when an agreement has been reached in principle but has not yet been signed.
